GTC - GENERAL TERMS AND CONDITIONS * * * 1. General: The following terms of service and payment apply to all orders placed on this website with ¡HOLA! Mallorca, managed by Philip Bornewasser ESY4375483T, hereinafter referred to as "¡HOLA! Mallorca". No other terms and conditions shall become part of the contract, even if we do not expressly object to them. Any provisions deviating from these terms and conditions shall only apply if they have been confirmed by us in writing. * 2. contracting party, conclusion of contract: Your service contract is concluded with ¡HOLA! Mallorca. You can order our service by filling in the online form or by ordering us by telephone or email. By clicking on the order button you place a binding order. Confirmation of receipt of your order will be sent by e-mail after you have submitted your order. As part of our service, we check the submitted forms for formal completeness in accordance with the requirements of the competent Spanish authority. The decision on the approval of your application is at the sole discretion of the Spanish authority. ¡HOLA! Mallorca cannot guarantee the issuance of a tax number or a residencia. We also reserve the right to subcontract all or part of your application to a third party. We also reserve the right to refuse any application. In this case we will inform you. We will accept your order by sending a statement of acceptance in a separate email or by delivering the required forms within two days. * * * 3. payment: After a deposit of 50% we will start working for you. You will have to pay the balance only after the service has been rendered. Before we hand over your NIE number and any other service rendered, payment must be made in full. The following payment methods are available to you for this purpose: 1. bank transfer: We will provide you with our IBAN bank details in Spain in a separate email. This way you can easily make a bank transfer. * 2. cash payment at collection: You pay the invoice amount in cash upon collection. * 3. paypal: We will send you the necessary payment information so that you can conveniently pay online. * 4. obligation to cooperate: You agree to provide any missing or incomplete documents and to cooperate in the processing of your application. If you fail to contact us with incomplete forms despite repeated requests, your documents will be returned to you via the cheapest postal route. ¡HOLA! Mallorca will not be held responsible for any loss or damage that may occur when sending the documents. * * * 5. processing times: We make every effort to process your order as quickly as possible. It is the sole responsibility of ¡HOLA! Mallorca to submit the documents and forms on time. However, sometimes delays cannot be ruled out. We try to meet deadlines set by you. However, they have no legal significance for us. The decision on the execution of the service (for example, the issuing of the NIE number or similar) is made by the respective authority in Spain. Unfortunately, we have no influence on this. In case of questions, complaints or objections on your part, we can be reached by e-mail at info@hola-mallorca.es. * 6. liability: Our service for you includes the following services: Acceptance of documents, accurate checking of forms and applications, forwarding of the complete documents to the competent authority and sending or handing over the documents to you. Of course, we promise to carry out your order properly and conscientiously. However, we cannot guarantee the success of your order. Likewise, we assume no liability for information provided. Decisions on the execution of an application are not subject to judicial review, especially not before a German court. Should a delay in sending the documents be caused by the Spanish authorities, ¡HOLA! Mallorca cannot be held responsible or liable for damages. We also expressly accept no liability or guarantee for compliance with any deadlines, irrespective of their significance for you or your order. * 6.1 Compensation in the event of failure to perform: Should documents that have been forwarded to ¡HOLA! Mallorca are lost or damaged, the liability is limited to € 100 per applicant. Should the completed documents be lost or damaged in transit to the applicant, then ¡HOLA! Mallorca will be liable for the exact amount you receive as compensation from the courier service. As a gesture of goodwill and without acknowledging any legal obligation, we are prepared in such cases to refund part of the replacement costs, up to a maximum of 100 €. * 7. data protection: With the establishment of the business relationship, your data, which may also be personal, will be stored internally and processed manually or in an automated process as required for the execution of the contract. Data will only be transferred to third parties for the purpose of executing the order if this is necessary. ¡HOLA! Jurisdiction: The applicable law is Spanish law and the place of jurisdiction is Palma de Mallorca in Spain. * * * 9. dispute resolution: The European Commission provides a platform for online dispute resolution (OS), which you can find here https://ec.europa.eu/consumers/odr/. We are willing to participate in an out-of-court dispute resolution procedure before a consumer arbitration board.
